Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
Business (referred to as either “the Business”, “We”, “Us” or “Our” in this Agreement) refers to The Lash and Brow Beauty Bar, 4268 Cahaba Heights Ct, Suite 137, Vestavia, AL 35243.
Client or You means the individual receiving services from the Business.
Services refers to all beauty services provided by The Lash and Brow Beauty Bar, including but not limited to lash extensions, brow services, permanent makeup, and related treatments.
Website refers to The Lash and Brow Beauty Bar website, accessible from thelashandbrowbb.com
Appointment means a scheduled time slot reserved for receiving Services.
Acknowledgment
By booking an appointment or receiving services from The Lash and Brow Beauty Bar, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
If you disagree with any part of these Terms and Conditions, please do not book or receive our services.
You represent that you are over the age of 18. We do not provide services to individuals under 18 without parental consent.
Appointment Booking and Cancellation Policy
Booking
- All appointments must be scheduled by calling (205) 881-0531 during business hours
- A consultation may be required for certain services, particularly permanent makeup
- You must arrive on time for your scheduled appointment
- Late arrivals may result in shortened service time or rescheduling
Cancellation and No-Show Policy
- 24-Hour Notice Required: Cancellations must be made at least 24 hours in advance
- Late Cancellations: Cancellations made less than 24 hours before your appointment may be subject to a cancellation fee
- No-Show Policy: Failure to show up for a scheduled appointment without notice may result in a charge and/or inability to book future appointments
- Deposit Requirements: Certain services may require a deposit at time of booking, which may be non-refundable if cancellation policy is not followed
Rescheduling
- We understand that emergencies happen. Please contact us as soon as possible to reschedule
- Multiple last-minute cancellations or no-shows may result in requiring deposits for future bookings
Service Terms
Client Responsibilities
Before your appointment, you must:
- Arrive with clean, makeup-free face for lash, brow, and PMU services
- Disclose any allergies, sensitivities, or medical conditions that may affect services
- Follow all pre-care instructions provided for your specific service
- Inform us if you are pregnant, nursing, or have any health conditions
After your appointment, you must:
- Follow all aftercare instructions provided
- Use only recommended products on treated areas
- Contact us immediately if you experience any adverse reactions
Service Guarantees and Limitations
- We use only high-quality, professional-grade products
- All technicians are certified and trained in their respective specialties
- Results may vary based on individual factors including skin type, lifestyle, and aftercare compliance
- Touch-ups for permanent makeup are required and scheduled 6-8 weeks after initial service
- Lash extension fills are recommended every 2-3 weeks to maintain fullness
Contraindications
We reserve the right to refuse service if:
- You have active infections, pink eye, or skin conditions in the treatment area
- You are under the influence of alcohol or drugs
- You have not disclosed relevant medical information
- We determine the service would be unsafe or inappropriate
Payment Terms
- Payment is due at time of service
- We accept cash, credit cards, and debit cards
- Prices are subject to change without notice
- Packages and memberships have specific terms outlined at time of purchase
- No refunds are provided for services already rendered
Health and Safety
- We maintain strict sanitation and hygiene protocols
- All tools are properly sanitized or disposed of according to health regulations
- We reserve the right to refuse service to anyone who appears ill
- Patch tests may be required for certain services, particularly PMU and tinting
Liability
Limitation of Liability
- The Lash and Brow Beauty Bar is not liable for allergic reactions when proper disclosure was not made by the client
- We are not responsible for poor results due to failure to follow aftercare instructions
- You acknowledge that beauty services carry inherent risks and you accept those risks
- We maintain liability insurance for covered incidents
Client Acknowledgment
By receiving services, you acknowledge:
- You have been given the opportunity to ask questions about the service
- You understand the service process and expected results
- You have disclosed all relevant medical and health information
- You will follow all aftercare instructions
- You understand results are not guaranteed and may vary
Photo and Video Consent
By receiving services at The Lash and Brow Beauty Bar, you grant us permission to take before and after photos for our records. If we wish to use your photos for marketing purposes (social media, website, promotional materials), we will obtain your explicit written consent.
You may opt out of photos at any time by informing your technician.
Governing Law
These Terms and Conditions are governed by the laws of the State of Alabama, United States.
Disputes Resolution
If you have any concern or dispute about our services, you agree to first try to resolve the dispute informally by contacting us at (205) 881-0531 or via email.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Changes to These Terms and Conditions
We reserve the right to modify or replace these Terms at any time. Material changes will be communicated to active clients. Continued use of our services after changes constitutes acceptance of the new terms.
